- In old English law, not answerable. Not punishable; e.g. "This murder is dispunishable." Disputable presumption. A species of evidence that may be accepted and acted upon when there is no other evidence to uphold contention for which it stands; and when evidence is introduced supporting such contention, evidence takes place of presumption, and there is no necessity for indulging in any presumption. A rule of law to be laid down by the court, which shifts to the party against whom it operates the burden of evidence merely. City of Montpelier v.
